Grievances and Assessment Concerns

Taxpayers have the right to challenge their property’s assessment every year by filing an application for correction with the Nassau County Assessment Review Commission (ARC), between January 2nd and the first business day in March. ARC is an independent tribunal separate from the Department of Assessment.
The deadline to file an Assessment Grievance (challenge) for the 2012-13 Roll has been extended until April 23, 2011.
Residents can obtain grievance forms by calling 311 or coming into the Tax Office.
There is a new assessment for each year which is published on January 2nd. If you disagree with your assessment, you should appeal it even if you have not received a determination on an appeal you filed previously. Your new assessment will be used to calculate your School Tax bill issued in October of the following year and General Tax bill issued in January, two years later. The time to appeal ends long before property tax bills are issued. You should appeal if you feel that your new assessment is too high; do not wait to see how much it affects your tax bills.
ARC may reduce your assessment but cannot increase it. You are not required to have an attorney. Property owners may represent themselves. If you hired a representative to challenge a prior assessment, you are free to change representatives or to file on your own behalf. You may also file an appeal with ARC If you applied to the Department of Assessment for an exemption and it was not granted, or if you feel your property’s class designation is incorrect.
If you have access to the internet the best way to file your challenge to your assessment is on-line via AROW. This is a free service that allows you to research residential sales, file appeals for all types of property, and monitor your appeal. Go to www.nassaucountyny.gov/arc and click the link for AROW. You can file on-line until April 23, 2011 but it is best to file prior to that date for faster access. You will get immediate confirmation when your appeal is received.
If you do not have access to the internet, you may call ARC after January 1, at (516) 571-2391, to get a grievance application and instructions. Send the completed form by regular mail or express service or hand deliver. Again, it must be postmarked or received by the first business day in March.
After reviewing your appeal, ARC will send you a notice of its determination. If you accept a proposed offer of an assessment, tax bills based on that assessment will be reduced. If you do not accept a reduction, you will receive a final determination and advice on your right to seek judicial review.
Small Claims Assessment Review (SCAR) is available only if you first appealed to ARC. Small Claims is an optional form of judicial review, which most homeowners may pursue without an attorney.
